Terms and Conditions

When an order is placed, the customer accepts our Terms & Conditions. Terms & Conditions may change without prior notice. 

 

Orders

Minimum opening orders and re-orders are a $750 minimum. Blue Ocean Traders’ merchandise is priced wholesale to the trade only. New customers must provide a valid Sales & Use Tax ID Number and fully complete our tax ID form before any order will be processed. Orders must be written in case-pack quantities {indicated by minimums in the catalog}. Blue Ocean Traders reserves the right to increase quantities to meet case-pack requirements. Order confirmations will indicate estimated ship dates. Actual ship dates may change due to circumstances and availability. All order changes and cancellations must be made in writing via email to your account manager.

 

Payment Terms

Blue Ocean Traders does not extend terms. Accepted payment methods are cash, check, credit card, or wire transfer. Payment must be recieved before orders will be packed or processed. For credit card orders, you will be charged the day before the order ships. A $30 fee will be charged for any returned checks. 


 

Prepayment Required

Pre-payments are required on all orders and must include the cost of shipping. Blue Ocean Traders will contact a customer up to three times {via phone or email} to collect payment information to process an order. The third and final contact will notify the customer that their order will be automatically closed within 48 hours unless Blue Ocean Traders is contacted with payment information. If the order is closed, the goods will be released, and a new order must be placed. Customer agrees to pay all collection costs and attorney fees on late payments.


 

Lead Time

We can often ship the same week your order is placed, if items are in stock. However, average lead time is 6-8 weeks, but this can vary greatly as our inventory is constantly turning over. Please feel free to contact us if you would like to request an ETA for your order, and we will do our best to provide you with the most accurate estimate. Blue Ocean Traders will contact a customer for order processing approval if the order lead time exceeds 90 days.


 

Shipping

Orders are shipped FOB Louisville, KY. Shipping rates are calculated based on transit distance and the shipment density. Average shipping cost is 18-20% of the purchase order. Blue Ocean Traders will contact the customer for approval if shipping cost exceeds 22%. When placing your order, please verify that all contact information is correct, including billing and shipping. Special shipping requests must be made at the time of order. Any fees associated with special requests are the responsibility of the customer and must be prepaid before delivery; Blue Ocean Traders will not be held responsible. Blue Ocean Traders does not drop ship or ship C.O.D. Blue Ocean Traders does not guarantee ship dates. Unauthorized returns and refused shipments will be charged a 20% restocking fee and all freight charges. 


 

Backorders

Backorders will be sent once merchandise totals $750 or above, or customer may elect to add items to ship with backorders to lower freight percentage. 


 

Pricing/Discounts

Prices may be subject to change without notice. Only approved customers may purchase our items at wholesale-level pricing. A volume-level discount of 20% will be given to each $20K order. This discount can be granted as often as a $20K order is placed. Customers are welcome to ask their account manager about Preferred Partner and container discounts. 


 

Sale

Sale pricing is not applicable on past purchases. Items purchased at a discount during sale events are available while supplies last. After placing an order, your account manager will contact you regarding item availability and shipping cost. Shipping costs will be calculated from the order total before any discounts are applied. Volume and Preferred Partner discounts do not apply on sale items.


 

Product Information

Most Blue Ocean Traders’ products are antique, handcrafted or vintage items. Expect variations in color, size, texture and finish. These are not flaws.  


 

Damages or Claims

Blue Ocean Traders advises not signing for orders that appear to be damaged. Please examine your order upon arrival for any discrepancies. Blue Ocean Traders will not provide additional packing for returns, so please keep it until after all items are inspected, in case an item must be returned. Claims with images must be submitted at blueoceantraders.com within 7 days of receipt. No returns will be accepted without prior approval. Call tags will be issued at Blue Ocean Traders’ discretion. Credit amount will be determined within 7-10 business days of receipt of your claim form. Replacements for claims are based on availability at the time a claim is received. All credits will be applied to future purchases or refunded via check. Refunds are issued once returned merchandise is received at our warehouse. Unauthorized returns and refused shipments will be charged a 20% restocking fee and all freight charges. If you need additional information about your claim, please email customercare@blueoceantraders.com. All off-market or Cash & Carry purchases are final.

All floor samples purchased and picked up directly from our showrooms are final. We do not process claims on floor sample sales.

 

Compliance With Laws

By accepting any products from Blue Ocean Traders, you agree and acknowledge that you will comply in all material respects with all applicable laws, rules, regulations, orders and decrees of all governmental authorities, including, without limitation, California Proposition 65 {the California Safe Drinking Water and Toxic Enforcement Act of 1986}. For all products purchased from Blue Ocean Traders and sold either at retail in California or to a customer residing in California, you agree and acknowledge that you will affix appropriate labels and provide appropriate notice to the consumer in compliance with California Proposition 65. The fact that Blue Ocean Traders may choose to label its products does not limit or eliminate your labeling and notice requirements as set forth herein.


 

Indemnification

Customer shall indemnify, defend and hold harmless Blue Ocean Traders and its officers, directors, managers, shareholders, members, partners, employees, agents, affiliates, and successors {collectively, "Indemnified Party”} against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs or expenses of whatever kind, including reasonable attorneys’ fees, costs and expenses of enforcing any right to indemnification incurred by Indemnified Party, relating to or resulting from any claim of a third party arising out of or occurring in connection with {1} Customer’s negligence or willful misconduct or {2} breach of these Terms and Conditions, including, without limitation, Customer’s failure to properly label products or provide appropriate notice and warning to California consumers with respect to products containing Proposition 65 chemicals. Customer’s indemnification requirements contained herein shall not be limited or eliminated by any labeling of products by Blue Ocean Traders.
